Minimum Personal Data Determination Guideline

Saudi Arabia Β· Guideline Β· SDAIA

Our summary

This guideline helps organizations comply with Saudi Arabia's Personal Data Protection Law by establishing principles for limiting data collection to only what is required for a stated business objective. It applies to data controllers and provides practical examples of when data collection is appropriate versus excessive. Controllers must regularly review their practices, train staff on data minimization, and delete information once it no longer serves the original purpose.

Introduction

This guideline assists entities subject to the Personal Data Protection Law and its implementing regulations in fulfilling their obligations to process personal information while avoiding unnecessary collection. It offers practical guidance for compliance with data minimization requirements.

Objective

The guideline aims to help entities apply the law effectively, promote adoption of best practices in personal data handling, provide examples for assessing compliance with data processing rules, and safeguard the privacy rights of individuals.

First: Minimum Collection of Personal Data

Requires data controllers to collect only personal information that serves an identified purpose, following principles of actual necessity, clear collection methods free from deception, limited content scope, secure destruction when no longer needed, and ongoing retention reviews. Controllers must regularly assess retained data to remove anything irrelevant or surplus to the original purpose and must delete information once that purpose expires.

Second: What Constitutes β€œMinimum” Personal Data?

Controllers must establish clear links between collected data and its predetermined purpose, collecting only what is necessary without additional unnecessary information. Data processing activities should be designed with appropriate software tools and automated reviews to prevent superfluous collection and ensure data accuracy and timely destruction.

Examples

These examples illustrate when data collection is unnecessary, such as collecting health information from all recruitment applicants when only specific positions require it, versus when collection is justified, like storing blood types of employees in high-risk roles for emergency medical response purposes.

Third: Controller Obligations

Controllers must regularly audit personal data processing for compliance with data minimization requirements and implement corrective measures, document all procedures when repurposing data, and ensure staff involved in collection and system design receive training on minimization obligations including privacy by design approaches.

Controls
