Romanian taxpayers penalized after relying on AI chatbot tax advice
Romanian taxpayers who sought tax guidance from AI chatbots received incorrect advice that resulted in significant penalties from tax authorities. Two cases are documented: one taxpayer faced 55% in penalties and interest after relying on incorrect advice about foreign broker withholding obligations, and another received guidance that ignored bilateral tax treaty provisions regarding dividend taxation.
What happened
More Romanians are consulting chatbots for tax advice. The AI responses, though sounding professional, have proven incorrect and generated penalties, interest and amended declarations.
One taxpayer who traded through an external broker assumed based on an AI response that the tax had been automatically withheld by the broker. The non-resident broker does not enter Romania's withholding tax mechanism, and the taxpayer was obligated to declare through the Unique Declaration. The taxpayer learned only after 4-5 years through an ex officio tax decision that he was assessed penalties of 55%.
Another taxpayer with dividends from Ireland where 25% tax was withheld later learned that Romania recognizes only 3% of this under the bilateral convention, leaving a difference to pay.
Reported impact
The cost of erroneous advice is not only financial. Beyond interest and penalties, taxpayers bear time lost with amended declarations, administrative stress and, for companies, reputational risk.
Ioana Dragu, senior manager at Think People consulting, stated that AI becomes risky when it replaces factual analysis, documents and correct classification, as it does not know the context of a taxpayer's situation.
Index analysis
AI chatbots respond confidently without hesitation or inquiry whether the situation is more complicated than the question asked. The systems do not know whether a taxpayer had a loss the previous year, faces restructuring or has a fiscal decision that changes the entire calculation.
