Puerto Rico sues Meta and Instagram over addictive content harming minors
Puerto Rico's Department of Justice sued Meta Platforms and Instagram, alleging they knowingly expose minors to addictive technologies and dangerous content that harm mental health. According to the lawsuit, the companies design their platforms to drive compulsive adolescent use while maintaining inadequate content moderation, particularly for Spanish-language material.
What happened
Puerto Rico's Department of Justice filed a lawsuit against Meta Platforms and Instagram on December 19, 2024, in the Superior Court of San Juan alleging the companies expose users, especially minors, to addictive technologies and dangerous content.
An investigation by the Monopolistic Affairs Office (OAM) of Puerto Rico's Department of Justice concluded that Meta and Instagram falsely claim to have adequate content controls, when in fact they design their platforms with knowledge that they direct adolescents toward compulsive use causing high levels of anxiety and depression.
Reported impact
The lawsuit alleges Meta and Instagram exploit neurological vulnerabilities of minors, knowing this contributes to a mental health epidemic. Reports presented to the Centers for Disease Control link excessive social media use to depression, anxiety, insomnia, and interference with education and daily life.
In 2021, more than 36% of high school students in Puerto Rico reported episodes of mental distress. Approximately 75.9% of Instagram users in Puerto Rico are minors. The lawsuit states the companies are aware that predatory adults contact minors through their platforms and have failed to warn parents or effectively counter this problem.
Index analysis
The companies claim to employ adequate controls for content moderation, but the Puerto Rican investigation found this to be false. The lawsuit argues that content moderation in Spanish on Meta's platforms is minimal.
