Musician sues Google over AI Overview falsely identifying him as sex offender

What happened

Google's AI Overview feature published false information claiming that Canadian musician Ashley MacIsaac was a convicted sex offender who had engaged in sexual assault, internet luring of a child, and assault causing bodily harm, and had been listed on the national sex offender registry for life.

MacIsaac learned of the false information after the Sipekne'katik First Nation cancelled a concert he was scheduled to perform on 19 December following public complaints citing the Google AI-generated misinformation.

Reported impact

The Sipekne'katik First Nation issued a public apology to MacIsaac, stating that decisions to cancel his performance were based on incorrect information generated through the AI-assisted search that mistakenly associated him with unrelated offences.

MacIsaac reported experiencing 'tangible fear' about performing and said he feared for his own safety on stage due to the false allegations. Google did not contact him or offer an apology.

Index analysis

MacIsaac's lawsuit alleges that Google knew or ought to have known the AI Overview was imperfect and could return untrue information, and that Google is liable for injuries arising from the defective design and foreseeable republication of defamatory claims.

Governance controls

The lawsuit argues that if a human spokesperson had made the same false allegations on Google's behalf, significant punitive damages would be warranted, and that Google should not have lesser liability because the statements were published by software Google created and controls.
