Japan's first prosecution for AI-generated child sexual abuse material
A 34-year-old former elementary school teacher in Nagoya was prosecuted in December 2025 for possessing AI-generated sexual images of real children, marking Japan's first criminal charge under child pornography law for synthetic media. The images were created using an internet-based generative AI tool to depict actual students from his school in sexual poses.
What happened
In March 2025, a 34-year-old former elementary school teacher in Nagoya used an internet-based generative AI site to create edited and manipulated sexual images of children. He sent images of two real child victims from his school to another person via social media, who then used generative AI to create nude versions of those images.
On 5 December 2025, the Nagoya District Prosecutors Office charged him with violation of the Child Prostitution and Child Pornography Prohibition Act (possession). This is Japan's first prosecution under this law for AI-generated child sexual abuse material.
Reported impact
The man had previously been charged with sexual coercion and other offences related to sharing images of children in social media group chats. He was indicted on those charges, with his trial already underway.
Index analysis
According to expert commentary, prosecutors determined that the AI-generated images constituted child pornography under the law because the original images of real children were identifiable from the generated material. This challenged prior legal interpretation that the law applied only to 'actual children' and made deepfake application difficult.
A law professor specializing in obscenity regulation noted that the court's determination that real children's facial features were recognizable in the generated images was crucial to the interpretation. However, he cautioned that the boundary between generated and creative content remains ambiguous, and legal application should be limited to cases where original and generated images show the same identifiable child.
