Conviction for AI-Generated Child Abuse Material Distribution
A Spanish court convicted a man of distributing child sexual abuse material generated using AI to create synthetic images from photographs of his relatives and neighbors, including minors. He was sentenced to five years and nine months in prison after confessing to distributing material via social media platforms and paying 30,000 euros in victim compensation.
What happened
A man was convicted by the Audiencia Provincial de AlmerÃa and sentenced to five years and nine months in prison for distributing child sexual abuse material generated with AI. He created synthetic images and videos by manipulating photographs and videos of relatives and neighbors, including his niece, his ex-sister-in-law, and neighborhood girls, using generative AI technology.
From at least February 2023, the man shared files containing minors, including babies, in nude or sexual situations via Telegram and WhatsApp groups. He maintained 944 Telegram group memberships focused on sexual content, several dedicated to child sexual abuse material, and exchanged over 300 such files with other users. He manipulated real photographs of people in his social circle to depict them in explicit sexual acts with unknown bodies.
Reported impact
The victims included his niece, his ex-sister-in-law, and several neighborhood girls whom he accessed through his own young son. The material depicted minors subjected to degrading and humiliating treatment with representations of physical or sexual violence, including content showing babies.
Index analysis
The perpetrator and his contacts were aware of the young age of the minors whose images were used, as they openly discussed the girls' ages in group communications. The defendant acknowledged the material constituted a violation of the dignity and human rights of the persons whose images were used without consent for degrading, humiliating, and offensive purposes.
Governance controls
The court applied a significantly mitigated sentence based on the defendant's explicit confession in court and payment of 30,000 euros in compensation to the victims.
